Plaintiff has moved an application under Order VI Rule 17 CPC
praying for carrying out amendments in paras 2,14 and 15 of the plaint. It is
submitted that due to inadvertence certain averments were left out in the
pleadings. As summons of the suit is yet to be issued to the defendant, this
application is allowed. Amended plaint is taken on record.
Issue summons of the suit to the defendant for filing of PF on
06.09.2023. Plaintiff to file tracking report on affidavit for the date fixed.
Further, it be specifically mentioned on the summons that this is
a commercial suit and the defendant is required to file the written statement
along with statement of truth and affidavit of admission and denial of
documents within the prescribed period from the date of service.
