Present : Sh. Aditya Jain, Ld. Counsel for the plaintiff along with
Sh. Lokesh Jain, Proprietor of the M/s Mobile Jeans in person.
Sh. Modassir Hussain Khan, Ld. Counsel for the defendant
with defendant Sh. Jitender Singh in person through VC.
Although the matter is fixed for framing of issues, Ld.
Counsels for the parties state that settlement has been arrived at between
the parties vide Compromise Deed dated 06.09.2023, original copy of
which is filed on record. It is stated that after reconciliation of accounts, the
plaintiff has confirmed that the defendant has previously made payment of
Rs.40,38,465/- to the plaintiff which covers the suit amount of
Rs.32,06,462/- and therefore the plaintiff withdraws the present suit. The
defendant Sh. Jitender Kumar has appeared through VC and has confirmed
the settlement. He has been identified by Sh. Modassir Hussain Khan, Ld.
Counsel. Let statement of plaintiff and of Sh. Modassir Hussain Khan, Ld.
Counsel be recorded.
Statements of Sh. Lokesh Jain, Proprietor of the plaintiff and
of Sh. Modassir Hussain Khan, Ld. Counsel recorded on separate sheets.
Accordingly, suit of the plaintiff is disposed off as settled in
terms of the Compromise Deed Ex.C1. As settlement has been arrived at
between the parties, plaintiff shall be entitled to refund of full court fee.
Reader of the court to issue certificate in this regard.
File be consigned to the Record Room.
