Sh. Modassir H. Khan, Ld. Counsel for the defendant.
Ld. Counsel for the defendant has filed memo of appearance
which is taken on record. Ld. Counsel for the defendant submits that
although summons were issued to the defendant on the amended plaint,
copy of the unamended plaint has been received. The same is confirmed by
Sh. Aditya Jain, Ld. Counsel for the plaintiff who submits that due to
mistake unamended plaint was filed with PF.
Ld. Counsel for the plaintiff undertakes to supply the copy of
the amended plaint with complete set of documents to the defendant during
the course of the day. Subject to receipt of copy of the amended plaint and
complete set of documents during the course of the day, defendant to file
written statement, statement of truth and affidavit of admission and denial of
documents within 30 days from today with advance copy to counsel for the
plaintiff, who may file replication thereafter.
Put up for case management hearing/framing of issues on
19.10.2023.
