A perusal of record reveals that in the invoices, the plaintiff
has sought payment from the defendant for the supplied goods in its bank
account in IDFC Bank, Rajouri Garden Branch, however, it is emphasized
that one payment was received from the defendant in HDFC Bank,
Shalimar Bagh Branch. However, there is no document in this regard which
was filed along with the plaint.
Ld. counsel for plaintiff submits that some documents like e-
way bills and statement of bank account of HDFC Bank were filed along
with the replication. The said documents cannot be considered at this stage
without there being leave granted bhh the court as contemplated u/o 11,
Rule 1(5) CPC. Ld. counsel for plaintiff wants to move an appropriate
application.
In this view of the matter, list for further consideration on
28.04.2025 at 2.00 P.M.
