Order Details: COPY OF JUDICIAL PROCEEDINGS Pdf Text: 21 CS (COMM.) 30/24 Praveen Rajgarhia Vs. Murti Udyog Ltd. 01.12.2025 Present: Sh. Ram Kishan, Ld. counsel for plaintiff. Sh. S.S. Mittal, Ld. counsel for defendant through VC. The framing of issues in the matter is lying held up on account of pendency of application u/o. 11 Rule 1 (5) r/w. Section 151 CPC, seeking leave to file additional documents. The additional documents sought to be placed on record are in the nature of :- a) Product Information, b) GST Registration Certificate, c) e-way bill for supply exceeding Rs.50,000/- and d) Bank Statement for the relevant period. I have heard arguments advanced at Bar from both the sides and given thoughtful consideration to the arguments. The Ld. Counsel for plaintiff has very vehemently argued that the said documents are sought to be placed on record in answer to the case set up by the defendant in written statement. As far as GST registration certificate is concerned, the same is a statutory document and can always be taken on record and even plaintiff is entitled to call relevant witness from GST department to prove the same. Similarly, the bank statement can also be proved by summoning witness from the bank. As regards e-way bills for the amount of transaction exceeding Rs.50,000/- is concerned, except for one e-way bill, the number of other e-way bills have been duly mentioned in the invoices placed on record. As regards the product information, the plaintiff only seeks to specify the nature of the products supplied by him. The said documents were admittedly available to Cont……. -- 1 of 2 -- --2-- the plaintiff at the time of filing of the suit. It appears that there is a semblance of justification in seeking to file the said documents now. The application is accompanied by fresh statement of truth. Considering the fact that admission/ denial of documents is yet to take place, even issues in the matter have not been framed as yet, therefore, the application can be allowed subject however to the cost, to compensate the defendant. In this view of the matter, the application is allowed subject to payment of cost of Rs.2,000/- to be paid by the plaintiff to the defendant within 15 days from today. List for issues/ case management hearing on 12.01.2026. (Vinod Yadav) District Judge (Commercial Court)-02 North-West/Rohini Courts/01.12.2025 -- 2 of 2 --
