Considering the submissions, the application is
allowed.
It has been pointed out that a demand note has
been issued by defendant for electrification in the area,
however, the cost /payment which is required to be paid by
residents is at higher end. It is stated on behalf of defendant
that demand note has been issued considering that
electrification shall be done underground and a possibility
for overhead electrification shall be considered subject to
the plaintiff/residents undertake to comply the safety rules
for the same.
Considering the submissions made today,
defendant is directed to apprise the court on the NDOH
regarding any such possibility and also place on record the
rules with respect to the electrification.
