Fresh suit received by way of assignment, it be checked and
registered as per rules.
Present: Dr. Ankit Gupta, Ld. Counsel for the plaintiff.
The plaintiff has filed the present suit for
declaration, permanent and mandatory injunction alleging acts of
public nuisance and wrongful harm caused to residents and
general public at large alongwith applications under Order 39
Rule 1 and 2 CPC and u/s 91 CPC seeking leave of this court to
institute the suit.
Heard.
Upon perusal of the plaint, documents filed and the
application, this court is satisfied that the present suit filed is
prima facie of the nature contemplated u/s 91 CPC.
Accordingly, the application stands allowed and
leave is granted.
Let summons be issued to all defendants alongwith
notice of the application under Order 39 Rule 1 and 2 CPC on
filing of PF / RC / through all prescribed modes returnable for
NDOH.
