Counsel for defendant no. 2/BSES submits that, as per the instructions of the AR, he seeks to withdraw his application filed under Order 1 Rule 10 CPC on the LDOH. In view of the submission, the application stands dismissed as withdrawn. An application under Section 151 CPC has been filed on behalf of defendant no. 1. Taken on record. Copy be supplied. The plaintiff is directed to file reply, if any, to the application with advance copy to the defendant at least a week prior to the NDOH. At this stage, it is submitted by ld. Counsel for defendant no. 2/BSES that this court does not have the subject matter jurisdiction to adjudicate upon the relief sought in prayer clause ‘D’, which is the only remaining relief in the suit, the remaining reliefs having already been satisfied. He further submits that he shall file citations in support of his submission on the NDOH. Be put up for arguments on maintainability of prayer clause ‘D’/ suit and arguments on the application filed under Section 151 CPC by defendant no. 1 on 17.09.2026.
