ORAL ORDER :
This is an application for recalling the order passed
below Exh.8 by this court dated 13.08.2021 rejecting the application
on the statement that the Hon'ble High Court has appointed the
Court Receiver and Court Receiver is declined to accept the rent from
the plaintiff.
2. Read application and say filed thereon. Heard learned
advocate for defendant Nos.1B to 1F. None is present for other side.
3. After perusal of record, it is seen that the Hon'ble High
Court has discharged the Court Receiver for accepting the rent. Under
these circumstances, for fair trial, the matter needs to be reheard.
Hence, application succeeds and order dated 13.08.2021 passed
below Exh.8 is hereby recalled. Matter be fixed for fresh hearing on
interim application.
