ORDER BELOW EXH.-1
1] The applicant viz. Ghanshyam Ghanteshwar Pandey has
filed application for releasing his cash amount of I.2,500/- (Two
Thousand and Five Hundred) in his favour. Accused and the
Investigating Officer, gave no objection for handing over the seized
cash amount in favour of the applicant. Ld. A.P.P. submitted that the
seized cash amount will require for identification during the trial. It
is prayed that, necessary order be passed.
2] Heard both sides.
3] During the investigation cash amount is recovered. It
also appears that, as per the report lodged by present applicant, a
crime bearing No.1344/2018, punishable under section 379 of Indian
Penal Code, is registered against unknown accused, at police station,
Mumbai Central, Mumbai. In support of application applicant placed
on record copies of his Aadhar Card, F. I. R., and his own affidavit.
Accused has given no objection for handing over seized cash amount
to the applicant. It appears that investigation has been completed
and charge-sheet is also filed. No purpose would be served by
keeping the cash amount, at police station itself. Applicant is entitled
for getting custody of cash amount. Therefore, the order :

ORDER
1] The seized cash amount of I2,500/- (Two
Thousand and Five Hundred), be given to the
applicant/informant viz. Ghanshyam Ghantes-
hwar Pandey, R/o. Room No.17, Chawl No.43,
Bharat Nagar Road, Near Kherwadi Police
Station, Dnyaneshwar Nagar, Mumbai on
indemnity Bond of I.2,500/- (Two Thousand
and Five Hundred), which is to be executed
before Investigating Officer of Railway Police
Station, Mumbai Central, on following
condition :
(a) The applicant shall produce the cash amount, as
and when required.
2] The Investigating Officer shall furnish/kept the
Indemnity Bond alongwith the final report /
chargesheet, in this Court.
3] This proceeding be kept with the remand papers
of C. R. No.1344/2018 of Railway Police Station,
Mumbai Central, Mumbai for merging the same
in the main case after filing the chargesheet, if
any.
