Present application is moved by Inspector RPF Mumbai
Central local. It is stated that, as per judgment dtd. 19/10/2007
passed in C. C. No. 228/SW/2007, accused Nasruddin Jatim
Abbasipathan is convicted of the offence punishable under section 3
of RP (UP) Act. Other accused Ganiya was absconding. Therefore,
final order regarding seized property was not passed and it was
ordered to keep the property in safe custody. Now it is submitted
that the absconded accused Ganiya died on 12/06/2009.
2 Original record of C. C. 228/SW/2007 was called from
record room. It appears that as per judgment dtd. 19/10/2007,
accused Nasruddin is convicted and the property was not finally
disposed off, as the matter against absconded accused was pending.
Now the copy of death certificate is placed on record, which discloses
that the absconded accused Ganesh Kondiba Bhosale died, on
12/06/2009, at Satrasta, Mumbai. In these circumstances, no
purpose would be served by keeping the property in safe custody.
Hence, the property i.e. 12 meters, signal cable wire, 16 core, weight
20 K.G., worth `2,000/ be returned to railway authority, for its
disposal according to law. Original record of C. C. No. 228/SW/2007
be sent back to record room.
