ORDER BELOW EXH.1
1. The brief facts leading to present supplementary charge sheet are as
under -
Informant Smt. Medha Anees Jaffery, approached Bandra P.S.,
Mumbai, on 19.03.2020 and lodged report by making allegations against
one Mr. Rahul Karnik. On its basis offence at C.R. No.260/2020, was
registered for offences punishable under Sections 506 and 509 of Indian
Penal Code. Investigation started. During investigation the statement of
informant under Section 164 of Code of Criminal Procedure was
recorded. It is transpired in addition to it there are allegations against
Advocate Mr. Devdas Aroskar and Mr. Anacletus D'Costa, as well. But
the charge sheet is filed on 04.03.2022, only against Mr. Rahul Karnik.
The said charge sheet is registered as C. C. No.630/PS/2022, State Vs
Rahul Karnik.
2. Later on, on 16.04.2022, another charge sheet i.e. supplementary
charge sheet against remaining two accused persons i.e. Advocate Mr.
Aroskar and Mr. Anacletus D'Costa was filed bearing C. C.
No.1570/PS/2022, i.e. present matter has also been filed. Initially entry of
both the accused persons taken in C.I.S. But later on changes found to be
made and name of the Accused No.2, Advocate Mr. Devdas Aroskar, was
deleted from C.I.S. So also in the charge sheet his name was attempted to
be deleted by applying whitener.
3. The whole record of the investigation of the present matter reflect
that he is also involved in the alleged act. Prima facie case made out
against him as well. Therefore, following order -
ORDER
a. Cognizance of the offences punishable under Section 506 and 509
of the Indian Penal Code taken. Issue process against accused Mr. Devdas
Aroskar and Mr. Anacletus D'Costa.

b. Accused No.2, Mr. Anacletus D'Costa, present before court. He is
released on bail on his furnishing P.B. and S.B. of Rs.5,000/-. Cash
security allowed.
c. The relevant entry be taken in C.I.S. and name shall also directed to
be inserted in the relevant column of charge sheet, where whitener is
applied.
