ORDER BELOW EXH.01
1. This is an application for condonation of delay of 3 days caused
to file the complaint under section 138 of Negotiable Instrument Act.
2. It is contended that applicant was suffering from kidney stone and
he was discharged from the hospital on 17.01.2024 and therefore the delay
has been caused in filing the complaint.
3. The opponent duly served but failed to file his say.
4. The reason shown for delay is supported by medical certificate
and probable one. The delay is satisfied. Further, the delay is not intentional
nor it will take away the statutory right of the complainant/applicant.
Hence, I pass following order.
O R D E R
1) The delay stands condoned in the interest of justice.
2) The complaint be registered as per Rule.
3) Order dictated and pronounced in open court.
