MS DNYANA INFOTECH IN THE COURT OF METROPOLITAN MAGISTRATE, 58TH COURT, BANDRA, MUMBAI ORDER BELOW APPLICATION AT EXH.44 1. This is an application for closing evidence of the accused filed on behalf of the complainant on 07.11.2022. The Advocate for the accused objected the application vide say dated 16.02.2023 on various grounds with prayer to grant time to file the evidence. 2. Heard both sides. Today accused absent and failed to adduced evidence. Ld. Advocate for accused submitted that due to cyclone in Gujarat the accused could not come to file the evidence. There is cyclone at Gujarat but as on date the same is affecting only the Saurashtra region and mainly turned towards Kutch which has no concerned with the Rajkot. It seems prima facie the advocate for the accused are taking disadvantage of the liberty granted to them to adduce evidence since 16.02.2023. No genuine reasons and grounds for adjourning the matter. Hence, I pass following order. O R D E R 1) The evidence of accused stands closed. 2) Exemption application of the accused stands rejected. -- 1 of 2 -- 2 C.C.NO. 40/SS/2018 Exh.44 3) The case adjourned to 22.08.2023. 4) Order dictated and pronounced in open court.
