I solemnly affirm on oath that -
My name is Rajesh Jethnand Rohira
Age : 44 years,
Occupation : Partner of MIDAS Financial Services.
R/o. Khar (W), Mumbai.
Examination-in-Chief of CW-02 by advocate Mr. R. V. Yadav for the
complainant :
1. Money lenders as well as borrowers used to visit our office. I
am working as a broker for MIDAS Financial Services. We used to verify
the financing capacity as well as capacity of borrower for further
transaction of lending money. In present case of complainant, the
husband of the complainant who was money lender was knowing to
the accused Tarachand Chawla. Both might be college friends. Around
year 2017 the accused Tarachand Chawla had demanded loan from
husband of complainant Mr. Kan Chotharamani. Accordingly, he had
given the funds to accused Tarachand Chawla. He was getting interest
for some months. Every three months Mr. Kan Chotharamani used to
get interest from Tarachand Chawla. I was acting as a broker in said
transaction. In the year 2018 Tarachand Chawla slow downed paying
interest. Mr. Tarachand Chawla was to pay entire loan amount by the
end of Dec.2018. In the month of February, 2019 he started issuing
cheques to all Money Lenders for repayment.
2. Mr. Tarachand Chawla and his son Vinay Chawla have
executed the Bill of Exchange in favour of complainant Mrs. Anita Kan
Chotharamani. I can identify signatures over the Bill of Exchange if
shown to me. Now I am shown Bill of Exchange Exh.17. The signature
of drawer belongs to Mr. Tarachand Chawla and the signature of
acceptor belongs to Mr. Vinay Tarachand Chawla. Both signatures were

executed in my presence. At that time the husband of the complainant
was also present. Now I am shown cheque Exh.18. It bears signature of
Mr. Tarachand Chawla. The signature over cheque was not made in my
presence but the cheque was given to the husband of complainant in
my presence.

3. I am related to the case as broker. Mr. Jethanand Rohira
is my father and he is also partner of MIDAS Financial Services. Licence
is not required for brokership by the firm. I personally know accused
No.1 and 2 since year 2011-2012. It is true to say that at the time of
transaction only accused Mr. Tarachand Chawla and Mr. Vinay
Tarachand Chawla came to my office.
On oral request of the advocate for the accused cross
examination is deferred till next date.
