Order below Chamber summons No. 2138 of 2019.
Perused the Chambers summons, heard both sides.
Adv. for the plaintiff submitted that plaintiff No.1 was
expired on 13.01.2019, thereafter immediately he
moved the Chambers summons of bringing the LRs on
record while Chambers summons No. 1281 of 2019. It
was allowed on 16.09.2019. Thereafter, on the next day
plaintiff No. 2 expired. Therefore, amendment as per
Chambers summons No. 1281 of 2019 was remained.
Meanwhile, he filed Chambers summons for bringing the
same LRs on the record. Plaintiff No.1 and 2 were the
parents of the present proposed LRs. He submitted that
plaintiff be permitted to bring the LRs on record. Adv for
the defendant opposed the Chambers summons that
defendant No. 1 was the power of attorney holder of
both the deceased plaintiffs. Therefore, no need bring
the LRs on record.
As power of attorney different from the bringing the
LRs on record there is no substance in the argument of
defendant. Considering the nature of prayer following
order is passed.
Order
1) Chambers summons No. 2138 of 2019 is hereby
allowed in terms of prayer clause a and b.
2) Chambers summons disposed of accordingly.
