JUDGMENT
1. The Petitioner Mr.Anuj Parshuram Sutar has filed the present
adoption petition for Adoption of the female Child Riya, who was born
on 21/9/2010 to the Respondent .
2. It is the contention of the petitioner that the Respondent Renu
Anuj Sutar is his wife, they legally married on 22/3/2016 at Mumbai.
The first marriage of respondent was solomnized with Mr.Dilip
Achchelal Gupta on 10/12/2009 at Mumbai as per the Hindu Vedic
Rites and customs. Renu was born to the respondent out of the said
wedlock on 21/9/2010. Thereafter the respondent-mother of Riya got
divorce from her husband Mr.Dilip Gupta on 10/3/2016 as per the
order passed by learned Judge, Family Court, Mumbai in Petition no.F-
2016/2015.
3. Thereafter the respondent married with the petitioner, who is
desirous of adopting the child Renu as his daughter and he is treating
her as his daughter. The respondent has also given the consent for
adopting Riya by the petitioner. Consequently, present petition is filed.
4. It is pertinent to mention here that the petitioner has filed
certain documents like copy of marriage certificate with respondent,
Copy of birth certificate of child Riya copy of divorce petition passed by
learned Judge, Family Court Mumbai in the abovesaid petition, photo
of adoptive child with the petitioner and respondent, Mishap
certificate, consent letter of the adoptive parents, motivation letter,
affidavit-cum-undertaking for registration of the adoption deed,
medical fitness certificate of the petitioner as well as respondent so

also, of the child etc., as required.
5. The petitioner and respondent have also filed their evidence
affidavit on record so also, undertaking.
6. On perusal of the documents, evidence and after hearing the
argument of the learned advocate for the petitioner and respondent, it
appears that the petitioner is ready and willing to take minor Riya in
adoption as his daughter and the biological mother i.e.Respondent who
is now the wife of petitioner has also consented for the same as
discussed above.
7. It is necessary to mention here that the petitioner, respondent
alongwith minor Riya were present in my Chamber. I had brief
interaction with them. Petitioner appears to be very happy with his
decision to have minor Riya in adoption. I could see happiness of the
adoptive father-petitioner and respondent biological mother. They have
now feeling of completeness of the happy family.
8. Therefore, in the best interest of minor Riya and for her better
future it will be just and proper to allow the petition as the petitioner is
physically, mentally and financially fit to take the said Riya in adoption
as father and the respondent is already the biological mother of Riya.
9. In the result, in view of the aforesaid discussion for the welfare
and wellbeing of minor Riya, it is just and desirable to allow the
petition. In the result, following order:

O R D E R
1. Adoption Petition No.18/2020 is allowed.
2. It is declared that the Petitioner Anuj Parshuram Sutar is the
adoptive father of minor female child Riya Dilip Gupta and the
respondent Mrs.Renu Anuj Sutar is her mother. Henceforth, Riya is the
daughter of Petitioner and respondent.
3. The concerned Municipal authorities are directed to issue birth
certificate of Riya who was born on 21/09/2010 showing the name of
Petitioner Mr.Anuj Parshuram Sutar as her father and respondent
Mrs.Renu Anuj Sutar as her mother.
4. The petitioners are permitted to apply to the passport authorities
and all the Government/Semi Government authorities in respect of
issuance of passport, PAN Card, Aadhar Card and other necessary
documents in the name of Riya Anuj Sutar.
5. Adoption Petition No.18/2020 is thus disposed of accordingly.
