He has also filed the copy of consent terms before the appellate
authority of Maharashtra Real Estate Appellate. For administrative
purpose it is tor and marked as Exh. 11.

Perused the application. Heard Ld. Adv Shri Simerpreet Singh for
the pltff. It is submitted that the matter is settled out of court
between the parties. It is also submitted that similar dispute
between the parties pending before RERA is also settled by virtue
of consent terms Exh. 11. Thus it is submitted that as the matter is
settled, the pltff does not wish to continue with the suit.
Considering the reasons mentioned in the application and also
considering that the matter before RERA is settled, permission is
granted to withdraw present suit. Application Exh. 10 is allowed
and disposed of.

In view of order below Exh. 10 the suit stands disposed of as
withdrawn. Court fees is any be refunded to the pltff as per rules.
Suit be removed from board.
