This speaking to the minutes is taken out the Ld advocate for the
plaintiff for correction of typographical mistake in the Judgment
dated 30.06.2016 in Suit No.3976/1997. The said application is
consider as per the provisions under Section 152 of the C.P.C. I
have perused the proposed correction as mentioned in the
application. The first is with regard to the typographical
correction in the date mentioned in paras no.2 and 8 of the
judgment i.e. the date of death of the husband is mentioned as
22.05.1992 instead of 23.05.1992. The numerical correction
being typographical is done and after correction it be read as
23.05.1992. The other correction proposed is the surname is
typed as “Barge” instead of “Warge”. So where ever the surname
is appearing as “Barge” it be corrected as “Warge” being the
typographical mistake. So also in paragraph no.9, instead of the
word “prevision” it be read as “previous” being the clerical
mistake. So also the other proposed correction ie addition of
word “by” between the sentence “Sanad issued” and “ the
concerned authority” in paragraph no.9 being the clerical mistake
is done. The judgment be corrected accordingly and it be read in
the manner after corrections as pointed out in the application.
This application is allowed as per the provisions of Section 152 of
the C.P.C. All concerned to act upon accordingly. Misc.
Application is disposed of.
