ORDER
1. The plaintiff seeking addition of name of proposed
respondent in place of present defendant no. 3 as there is a
merger.
2. Heard both the sides. Perused Chamber Summons. It is not
in dispute that present defendant no. 3 is amalgamated with Shree
Sainath Enterprises Construction Pvt. Ltd. Looking to the
aforesaid fact, I am of the view to allow the plaintiff to amend title

clause and pleadings accordingly by deleting the present defendant
no. 3. Thus, I proceed to pass the following order :
ORDER
1. Chamber Summons No. 1366 of 2019 is hereby allowed in
terms of prayer clause (a).
2. Plaintiff is allowed to carry out necessary amendment as per
schedule within 14 days from the date of order.
3. After amendment issue notice to the defendant no. 3
4. Parties to bear their own cost.
3. Chamber Summons No. 1366 of 2019 stands disposed of
accordingly.
