Ld. advocate for defendant No.1 has submitted that he has received the possession of unit No.1301 in A Wing on floor - 13 of Rehab Building today from defendant No.3. He has tendered on record the possession letter dated 11.05.2021 along with the list of documents. The prayer in present Notice of Motion is single prayer to restrain defendant No.3 from parting with the possession in respect of permanent alternate premises in lieu of the original premises i.e. Room No.34/B situate at Merwanji Chawl, Opp. KEM Hospital, Parel, Mumbai - 400 012. As the possession is parted by defendant No.3, the prayer of plaintiff with respect to ad-interim relief has become infructous. It was argued by learned advocate for plaintiff that order with respect to defendant No.1 being bound by the result of the suit be passed also does not carry merits as same will be legal position which will be dealt at the time of final hearing and further same is not the prayer in this notice of motion. As stated above, there is single prayer against defendant No.3 and no other prayer especially against defendant No.1.
Defendant No.1 has filed reply today. As regards service of defendant No.2 and 3, learned advocate for plaintiff has submitted that the seal and stamp on the notice is of defendant No.3. He will file affidavit of service of defendant No.2 and 3 on next date.
