It appears that there is delay of 15days in filing the written statement. Considering the reason it appears that the delay caused in filing the written statement is not intentional or malafide. Since the unconditional leave is granted to the defendant to file his written statement vide order dated 09/03/2018 in Summons for Judgment no.9/16, it is just and desirable to permit the defendant to file the written statement on record, to meet the ends of justice, but subject to cost.
