Pradip Patil for MCGM recorded his reply on NM No.
1726/2018. Heard, respective advocates. Adv. Pradip Patil
strongly obejcted to restore the NM No. 173/2011 which
was dismissed for default. On the other hand Adv. Bhushan
submits that the original NM be heard on merits by
imposing costs on plaintiff. Considering the submissions
and nature of the suit, it is expedient to allow the NM No.
1726/2018 in order to decide the matter on merits. Thus the
following order is passed - ORDER 1. The Notice of
motion No. 1726/2018 is made absolute in terms of prayer
clause (a) and (b) subject to payment of costs Rs. 5000/- to
be paid /deposited with the concern ward office of
defendant on or before 23.01.2019. An ordinary copy of
this order duly authenticated by Sheristedar of this Court be
supplied to both the parties. Adjd for NM reply to
18.01.2019.
