effect at Exh.8 along with copy of death certificate. Till the
date the defendant has not brought on record the legal heirs of
deceased plaintiff. The Notice of Motion is filed by defendant
for setting aside Ex-parte decree. Thus, it was incumbent on
the defendant to bring the legal heirs of deceased plaintiff on
record. In consequent to failure to bring the legal heirs of
deceased plaintiff on record in the notice of motion, the Notice
of Motion No.1924/19 stands abated, can not be proceeded
further against their person. Notice of Motion No. 1924/19
stands disposed off as abated. Proceeding is closed.
