It appears from the Roznama dated 02-05-2022 the counsel of plaintiff has pointed that the plaintiff died on 07-04-2021, she filed an application to that effect at Exh.8 along with copy of death certificate. Till the date the defendant has not brought on record the legal heirs of deceased plaintiff. The Notice of Motion is filed by defendant for setting aside Ex-parte decree. Thus, it was incumbent on the defendant to bring the legal heirs of deceased plaintiff on record.
