No.1005/19. In brief, it is contention of the plaintiff that
after filing the present suit, the plaintiff on various
platforms/ internet searched for review and feedback in
respectof the disputed Jeevan Saral Policy (with profits) of
LIC and found that there are about 5 crore people across
India who have been cheated/ defrauded by the defts, in
particulars the deft no.1 and its employees. Plaintiff tried to
contact those people to get the status of their claim/
compliant/ suit/ proceeding before various forums. During
the said enquiry he found that, various judgements/ orders
of various forums in respect of the claim/ compliant/ suit/
proceedings of various investors. He sought the certified
copies of the said judgements and orders from the
respective investors, some of which have been received by
him. Therefore, it is necessary to amend the plaint to that
effect. Advocate for deft no.1 submitted that deft no.1
doesn&amp#039t want to file reply. Advocate for deft
no.2 also submitted that deft no.2 doesn&amp#039t
want to file reply. Therefore the CS is proceeded without
reply against deft no.1 and 2 as per order dt. 15/01/2020.
Heard both advocates. I am of the opinion that, an
opportunity can be given to the plaintiff to amend the
plaint. Hence I proceed to pass following order. ORDER
CS No. 1005/2019 is hereby allowed as under. 1. Plaintiff
is permitted to amend the plaint as per schedule of
amendment filed with the CS. 2. Plaintiff is directed to
amend the plaint as stated above within 14 days from the
date of this order. 3. Plaintiff is directed to file on record
amended copy of the plaint till next date. Matter adjd for
compliance on 06-03-2020 at 11.00 am.
