ORAL ORDER
1) Defendant No.2 has taken out present draft notice of
motion for condonation of delay in filing its written statement and for
taking its written statement on record.
2) Perused the notice of motion, affidavit in support of
notice of motion and record. Heard arguments of Ld Advocate for
defendant No.2 and Ld Advocate for plaintiff. Ld Advocate for plaintiff
submitted that plaintiff is not having any objection if the draft notice
of motion is allowed.
3) From the affidavit in support of notice of motion it
appears that plaintiff has demonstrated just cause for non filing of
written statement earlier and for condonation of delay in filing written
statement. It is not disputed fact that Hon'ble Apex Court as per order
in Suo Moto Writ Petition No.3/2020 had extended the period of

limitation. Moreover, the delay is also not substantial. Considering the
matter on record and above discussion and no objection given by Ld
Advocate for plaintiff present draft notice of motion deserves to be
allowed. Therefore, court proceeds to pass the following order:
ORDER
1) Draft notice of motion is made absolute.
2) Written statement of defendant No.2 be taken on record if tendered
on or before next date.
3) Draft notice of motion be registered for statistical purpose.
4) Draft notice of motion is disposed off accordingly
