Advocate for plaintiff submitted that plaintiff intends to file appeal and therefore the ad-interim injunction be continued for four weeks.
Advocate for defendant submitted that in view of prima- facie conclusions reached by this Court the protection may not be extended.
In this case, this Court has reached to a prima-facie conclusion that the plaintiff was carrying out the construction activities despite service of stop work notice. However, the plaintiff intends to challenge such conclusion before the Hon\''ble High Court. In case the protection is not extended the premises can be demolished. The protection as sought can be extended for a limited period with certain conditions. Considering circumstances, I pass following order -
ORDER
1. The ad-interim protection granted is continued for a period of one week from today.
2. The plaintiff shall not carry out any construction activity in the suit premises.
3. The defendant is at liberty to monitor the suit premises.
4. The plaintiff shall grant uninterrupted access to the officers of defendant to inspect the suit premises.
