Perused the N/m and reply.  Heard. The Ld.adv.for the MCGM submitted that the concerned officer who has passed the order, the copy of which is at page no.74 of the Plaint is not well.  On perusal of the fresh speaking order, the date of passing of order is not mentioned nor the date is mentioned below the signature of the concerned Asst.Engineer.  Admittedly, the plaintiff has preferred the earlier suit No.640/2018 and the same was disposed of as per order dated 06.03.2018(Page No.70).   On record, as per the document at page no.71, it shows that the plff had filed the additional reply and documents with the concerned authority. In consonance of the order dated 23.03.2018, the concerned officer of MCGM Jr.Engineer Mr.Sudhakar Chavan made a statement at Bar that the MCGM will pass a fresh order mentioning about the consideration of both replies of the plff dated 12.03.2018 and 26.02.2018.  In view of the statement made by the concerned officer, no purpose would be served in keeping the N/m and suit pending. Hence in view of the statement of the officer, the MCGM to pass the fresh speaking order and shall communicate the same in writing to the plaintiff.  If the order is adverse to the interest of plaintiff or against the plaintiff then no coercive action will be taken by the MCGM for period of two week after the date of communication of order upon the plaintiff. N/m No.1231/18 stand disposed of accordingly.
