Advocate for Defendant filed an application for grant of 4 weeks time for challenging order passed by this Court today in Notice of Motion no.1384/19, t.o.r. O-Other side to say. Advocate for Plaintiff filed say.
This application Exh.5 is taken out by Defendant for giving four weeks time to Defendant for challenging the order passed by this Court today in Notice of Motion no.1384/19.
Plaintiff has resisted application by filing her say contending that this application is false because court has decided Notice of Motion on merits, hence application is necessary to be rejected.
Heard Defendants advocate and Plaintiff\''s advocate. As this court has passed executable order in Notice of Motion no.1384/19, and as Defendant is intending to challenge said executable order before appellate court I find that for giving fair opportunity to Defendant to knock the doors of superior court operation of the order passed by this court in Notice of Motion no.1384/19 is necessary to be stayed for 4 weeks, hence I proceed to pass following order-
ORDER
1. Application Exh.5 is allowed.
2. Order passed by this Court in Notice of Motion is stayed for four weeks so that Defendant can get the opportunity to challenge this order by filing appeal against the order.
