advocates on Exh. 6. The plaintiff prayed for withdrawal of
the suit unconditionally and accordingly made endorsement
on Exh. 6. Order on Exh. 6 Adv. Khati submits that the
defendant has already removed the notice structure and the
plaintiff may be allowed to withdraw the suit
unconditionally. The plaintiff does not wish to have leave to
file fresh suit. Accordingly application Exh. 6 is allowed by
allowing plaintiff to withdraw the suit unconditionally.
Order on Exh. 1 1. In view of granting permission below
Exh. 6 the suit is dismissed as withdrawn unconditionally. 2.
No order as to costs. 3. Court fee be refunded to the plaintiff
as per rules. Order on Draft NM In view of withdrawing the
suit the draft NM is dismissed. The plaintiff is directed to
get register the suit and NM for statistical purpose only. An
ordinary copy of this order duly authenticated by
Sheristedar of this Court be supplied to both the parties.
