In view of order dated 21.07.2018 suit is dismissed by the court however, Ld counsel for plaintiff tender notice of motion on 14.02.2019 to which leave is granted. Thereafter after registration of notice of motion it was obligatory on the part of plaintiff to file affidavit of service to the defendant inspite of sufficient opportunities plaintiff has failed to file affidavit in service 03.07.2019,07.06.2019,05.07.2019,23.09.2019 today also plaintiff remain absent, advocate absent, failed to file affidavit in service no adjournment application is on record.
