The plaintiff and defendant no. 1 through authorized
representative and submitted that there is compromise
between them and entire amount Rs. 26,73,547.33 has been
received. The plaintiff has deleted defendant no. 2 to 5 by
filing pursis and withdrawn the suit against them.
As the plaintiff has received entire amount suit is to be
withdrawn.
The defendant no. 1 is also withdrawing the counter claim,
Hence following order is passed -
The Suit and Counter Claim stands disposed of in terms of
consent terms between plaintiff and defendant no. 1.
The case paper be filed and sent to record room.
No any order as to costs.
The Court fees be refunded as per rules.
As the suit stands disposed off, NM 4623/2023 stands
disposed of in view of the compromise.
