defendant present and filed VP on behalf of proposed
defendant. Heard both sides in CS No.196/2018. The
plaintiff has filed this chamber summons to add Woodland
Construction as D-3 and to make consequential amendment
in the plaint. The proposed defendant was served on
1.2.2018 with the chamber summons but it did not enter
appearance. None of the other defendants filed reply to the
chamber summons. By order dated 13.8.2018, the chamber
summons is ordered to proceed exparte against proposed
defendant. On perusal of the proposed amendment, I find
that it is necessary for proper adjudication of the suit and it
does not change the nature of the suit. Today, the Ld.
counsel appearing for proposed defendant is seeking time
for filing reply to the chamber summons. However, in view
of the order dated 13.8.2018, the question of granting time
for reply does not arise. Ld. Counsel for D-2 has not
objection to allow the chamber summons. Hence chamber
summons no. 196/2018 is allowed. The necessary
amendment be carried out within two wees. Amended copy
of the plaint be filed in the court with copy to the other side.
After the amendment is carried out, the plaintiff is directed
to serve the amended coy to the newly added defendant.
