No. 128 of 2020 The chamber summons No. 128/2020 is
filed by plaintiff in counter claim to name of plaintiff No. 1
as he/she expired. The Adv. for plaintiff has no objection
for deleting the name of plaintiff No. 1 and it is noted in the
chamber summons itself. The chamber summons is
supported by affidavit of Ms. Madhavi Prasanna plaintiff
No. 2 to the counter claim. The xerox copy of death
certificate of plaintiff No. 1 is filed. Plaintiff No. 1 expired
on 19.11.2019. The chamber summons is filed on
20.01.2020 therefore it is within limitation. The plaintiff
has filed chamber summons No. 209/2020 to bring legal
heirs of defendant No. 1(plaintiff No. 1 in the counter
claim). The application is allowed and the necessary
amendment is carried out by the plaintiff. Hence pass
following order ORDER 1. The Chamber summons prayer
(a) is allowed. 2. The plaintiffs in counter claim to carry out
amendment within limitation. 3. No order as to cost. 4.
Accordingly, Chamber summons is disposed of.
