ORDER below chamber summons No. 128 of 2020
The chamber summons No. 128/2020 is filed by plaintiff in counter claim to delete name of plaintiff No. 1 as he/she expired. The Adv. for plaintiff has no objection for deleting the name of plaintiff No. 1 and it is noted in the chamber summons itself. The chamber summons is supported by affidavit of Ms. Madhavi Prasanna plaintiff No. 2 to the counter claim. The xerox copy of death certificate of plaintiff No. 1 is filed. Plaintiff No. 1 expired on 19.11.2019. The chamber summons is filed on 20.01.2020 therefore it is within limitation. The plaintiff has filed chamber summons No. 209/2020 to bring legal heirs of defendant No. 1(plaintiff No. 1 in the counter claim).
