The plaintiff has filed service affidavit along with the bailiff report. The said bailiff report and the service affidavit suggest that one Mrs. Manjuri Mishra, Legal Executive of Defendant No.1 has received the writ of summons on behalf of defendant No.1 and defendants No.2 to 6. As per the case of the plaintiff, defendants No.2 to 6 are the directors of Defendant No.1 company. It is appearing that on the strength of receipt of the same writ of summons, the defendants No.1, 2, 5 and 6 appeared. So, there are sufficient reasons to presumed that Ms. Manjuri Mishra was the authorized person of the defendants No.1 to 6. Therefore, it has to be further infer that defendants No.3 and 4 are duly served. Despite the service of writ of summons, defendants No.3 and 4 failed to appear and therefore, suit to proceed ex-parte against them.
