JUDGMENT
1. Petitioner Pramila Sharad Kadam is the mother of Ms. Bhakti
Sharad Kadam aged, 35 years. Bhakti is suffering from mental
disability and unable to participate effectively in society equally with
others. The father of the Bhakti is no more. Bhakti is unable to take
care of herself. She has one fifth share in the property left behind by
her father. Petitioner has filed on record the Disability Certificate of
Bhatki issued by Medical Authority, Mumbai. Her disability is profound
intellectual disability is 100%.

She is unable to perform day to day activities. Hence, petitioner prayed
for his appointment as Guardian of her daughter Bhakti.
2] Public notice was issued in two new papers calling upon the
objection from the public to this petition. Those are at Exh.2 and 3. But
non appeared to object this petition. The other sisters of the Bhakti
have given no objection for appointing their mother as a guardian of
Bhakit. The interest of the petitioner is not against the Bhakti. Hence,
she is entitled for the appointment as a guardian of Bhakti Bhide.
Hence, I pass the following order.
ORDER
1. M.H. Petition No. 42/2021 is allowed.
2. The petitioner Smt. Pramila Sharad Kadam, is
appointed under section 14(1) of the Rights of Persons
with Disabilities Act, 2016 as the total support guardian for
Bhakti Sharad Kadam and as Manager of her Estate as
mentioned in paragraph five of the petition.
3. The petitioner shall file in this Court in a period of three
months from today and three months immediately after the
end of every financial year, the returns of the movable and
immovable properties and dues owned by Bhakti Sharad
Kadam.
4. The petitioner shall take prior permission of this Court
before transferring any of the movable and immovable

properties of Bhakti Sharad Kadam.
5. M.H. Petition No.42/2021 stand disposed of
accordingly.
