Read the application and reply. Heard. It appears that delay of seven days is caused for giving the appearance by pleader by defendant after service of writ of summons. Considering the reason mentioned in the affidavit filed alongwith the Chamber summons, it appears that delay is not caused intentional or deliberate. If the permission is granted to the defendant to file vakalatnama and contest the suit no prejudice would cause to the plaintiff. Hence interest of justice requires to allow the Chamber Summons, but subject to cost. In the result following order
ORDER
1. Chamber Summons no.61/19 is allowed.
2. The delay caused in filing vakalatnama by advocate for defendant is hereby condoned subject to cost of Rs.2000/- payable by defendant to plaintiff.
