By way of this NM, the appellant sought to bring on record
documents as per list Exh.5. Ld. Counsel for the respondent
recorded his say below NM and resisted the NM as the
documents has no bearing on the matter in hand.
At the stage of the arguments, this NM came to be filed.
The proposed documents the documents relating to the attempts
made by the appellant through RTA for getting information about
the creation of tenancy right in favour of appellant. No prejudice
would be caused to the respondent, if these documents are take
on record. I am incline to allow the NM in terms of prayer clause
(a) and pass the following order.
ORDER
Notice of Motion No.117/19 is allowed in terms of prayer clause
(a).
Partly heard Ld. Counsel for appellant on Misc. Appeal.
Adjd. to 15/01/2019 at 3.30 p.m. for further hearing.
