N/m, reply and documents on record. Heard Ld.Advocates of
both the sides. In the case in hand, it is not the allegations of
the MCGM that the shop itself is not unauthorized. The
allegations is that there is unauthorized horizontal extension
in front of the existing shop by using bricks masonry wall,
wooden and M S material etc.with G.I.Sheet roof. The
MCGM has filed on record the copy of sanctioned plan
which prima facie shows about existence of wall. In the
midst of the argument, the plff has made a statement that for
the notice structure he is ready to make an application for
regularization of the same. Hence, at this stage, on the
statement made by the plff and his advocate, no purpose
would be served in keeping this Notice of Motion and Suit
pending.
