Ld. Predecessor had recorded the statement of Ld.
Counsel for United India Insurance Co. on 19.12.2023 in which it
was stated by Ld. Counsel that the insurance co. had issued a
stand alone own damage insurance policy with respect to the
vehicle no.UP-16DC-3021 and as per the policy document, the
said vehicle was insured with Kotak Mahindra General Insurance
Co. Ltd. for third party liability.
In these circumstances, especially when appearance
on behalf of Kotak Mahindra has been entered into, the
respondent/ United India Insurance Co. is hereby deleted as a
respondent in the present petition.
On behalf of respondent/Kotak Mahindra General
Insurance Co. Ltd. reply has been filed. Inter alia in the reply, it
has been stated that the IO may be directed to supply the copy of

CCTV footage to the respondent/Kotak Mahindra General
Insurance Co. Ltd.
Issue notice to the IO on filing of PF by
respondent/Kotak Mahindra General Insurance Co. Ltd. along
with copy of order to file the CCTV footage and also to appear in
person for clarification.
Also issue court notice to the petitioner to appear in
person.
Put up for further proceedings on 06.08.2024.
