Counsel for the defendant.
Matter is fixed today for plaintiff evidence. Four witnesses
are present in the court including two summoned witness.
Sh. Shubham Shekhar, Ld. Proxy Counsel for the defendant
prays for an adjournment. Same is opposed by Ld. Counsel for the plaintiff
on the ground that as per case management hearing conducted on
18.10.2023 date was fixed for today as per the convenience of the Ld.
Counsels for the parties.
In view of the fact that date for evidence was fixed for today
as per convenience of the Ld. Counsels for both the parties and no
plausible explanation or ground being given for seeking an adjournment by
the Ld. Proxy Counsel for the defendant, prayer for adjournment is
declined. Let witness be examined.
Sh. Hans Kumar Jain, Director/AR of the plaintiff company
Sh. Chaman Singh, Accountant and Sh. Vinay Kumar, Superintendent,
GST Department are examined as PW-1, PW-2 and PW-3 respectively.
Their cross-examination is treated as nil as Sh. Shubham Shekhar, Ld.
Counsel for the defendant submits that he has no instructions to cross-
examine the witnesses. They are discharged. The fourth witness Sh. Karan
Nagpal has not brought the desired records. Sh. Munish Chokker, Ld.
Counsel submits that he does not intend to examine the said witness and
drops him. He further submits that plaintiff evidence may be closed.

Statement of Sh. Munish Chokker, Ld. Counsel for the plaintiff
recorded to this effect on a separate sheet. Put up the matter for defence
evidence on 08.11.2023. Copies of evidence be supplied three days in
advance to the Ld. Counsel for the plaintiff.
