Matter is today fixed for consideration of the application of the
plaintiff under Order XI Rule 1(5) of the CPC dated 26.09.2023 to place on
record additional documents. Ld. Counsel for the defendant submits that he
does not intend to file any reply to the application. He further submits that he
is under instructions to state that defendant does not oppose the prayer made
in this application. Let statement of the Ld. Counsel for the defendant be
recorded separately.
Statement of the Ld. Counsel for the defendant recorded on a
separate sheet. Accordingly, application of the plaintiff under Order XI Rule
1(5) of the CPC is allowed. The recorded conversation contained in the pen
drive along with Hindi transcription and GST Returns are taken on record.
Put up the matter for plaintiff evidence on 02.11.2023.
In case any witness is to be summoned, plaintiff to file
appropriate application in advance to ensure that the witnesses are summoned
for the date fixed.
