Sh. Jitender Ratta, Ld. Counsel for the defendant.
On the last date of hearing, plaintiff evidence was closed after
Ld. Counsel for the defendant failed to cross-examine any of the plaintiff
witness. Today Ld. Counsel for the defendant has moved an application
praying for permission to cross-examine the plaintiff witness.
It is submitted that Ld. Counsel for the defendant was unwell on
the last date of hearing and Sh. Shubham Shekhar, Junior of Ld. Counsel for
the defendant being new in the profession was unable to inform the court
about the same.
As the application is based on the health grounds, same is not
opposed by the Ld. Counsel for the plaintiff. Application is accordingly
allowed. Defendant is granted one opportunity to cross-examine the
plaintiff’s witnesses.
At this stage, Ld. Counsel for the defendant submits that he does
not wish to cross-examine PW-3 who is an official witness.
Accordingly, put up the matter for cross-examination of PW-1
and PW-2 on 28.11.2023. Witnesses to remain present on the date fixed.
Ld. Counsel for the defendant has filed affidavit of evidence on
behalf of defendant Sh. Jag Pravesh Oberoi. Copy Supplied.
