It is stated that the case has been assigned to the ld. LAC on
behalf of defendant no.1 on 03.05.2024 and thereafter, sometime is sought by
the ld. LAC to file the WS along with an application under Order VIII Rule 1
CPC seeking condonation of delay in filing the WS. Let the needful be done.
Affidavit of service filed on behalf of plaintiff. As per the
counsel for plaintiff, copy of the application has been sen to the defendant
through speed-post. In the interest of justice, one more copy be supplied to
the ld. LAC for the defendant no.1 within two days. Defendant may file
reply to this application also.
Meanwhile, as none has appeared on behalf of defendants no.2
& 3, stipulated period of 30 days for filing WS has expired. hence, the right
of defendants no.2 & 3 to file WS is closed and defendants no.2 & 3 are
proceeded ex parte.
