Rajni Vs. State and ors.
Cr. Rev. No. 05/2024
12.09.2024
Present: Sh. Vikram Singh Bhatia, Ld. counsel for revisionist.
Sh. Parmod Kumar, Ld. Addl. PP for State/respondent
no.1.
Sh. Sajid Ali, Ld. Proxy Counsel for R2 to R5 along
with R5 in person.
Today, this revision is fixed for further arguments on
application for condonation of delay/FP.
Arguments heard.
It is clear from the record that after passing of
impugned order dated 28.06.2023, revisionist has failed to file the
revision within the stipulated period of 90 days as it has been stated
that due to heavy rush in certifying agency, she could not receive
the certified copy of impugned order. It is further clear that there
has been a delay of 73 days in filing the present revision. Although,
the delay stated above is huge, but in the opinion of this court, said
delay seems to be inconsequential and it may well be stated that
irreparable loss shall be caused to the revisionist in case present
application is not allowed. Further, the delay does not seem to be
deliberate or intentional as no reasonable person would cause harm
to himself or herself on purpose by not pursuing a legal remedy
within stipulated time. Accordingly, without further dwelling into
this aspect, by taking a liberal view, delay in filing the present
revision is hereby condoned subject to cost of Rs.1,500/- to be paid
