Accused with Ld. Counsel.
There is sufficient material on record to prima facie
reach a conclusion that an offence u/s 138 of the NI Act seems to
have been committed by the accused. Accordingly, a notice of
accusation u/s 251 Cr. P. C for offence u/s 138 of the NI Act is
served upon the accused to which he pleaded not guilty and
claimed trial.
At this stage, statement of accused u/s. 294 Cr.P.C.
recorded. In view of the statement, complainant has dropped the
witness from serial no. 2 & 3.
Considering the defence disclosed, need for moving
formal application u/s. 145(2) NI Act is dispensed with and
accused is granted opportunity to cross examine the
complainant/AR through his counsel on NDOH.
Further, it appears that evidence may need to be
recorded in detail in this case and therefore, the present case shall
be tried as a summons case.
