Defendant no.1 unserved at all the three given addresses
with the report at first and third address ‘sold out/left’. One other
address has been given which has not been served with the report
‘incomplete address’.
Defendant no.2 and defendant no.3 have been impleaded
as guarantor and are yet to be served.
Le the plaintiff bank take dasti summons for onward
service, in respect of official address of defendant no.1, who is
stated to be a Government employee with liberty to approach any
other office, where she may have been transferred.
Regular process/summons be issued against
defendant no.2 and 3 on steps.
Let Summons for settlement of issues of the Suit be
issued upon the defendant(s), on filing of PF, RC & requisite Copies.
Summons to be issued under Order V Rule 5 CPC 1908 upon the
defendant(s) shall display mandatory endorsement “defendant should
file Written Statement of defense within 30 days from the date of
service/receipt of summons alongwith Statement of Truth and
Affidavit of admission/denial of documents of the plaintiff”, as per
Commercial Courts Act, 2015.
Steps be taken within four weeks.
