The defendant no.1 was served by way of publication in
newspaper ‘Veer Arjun’ and ‘Statesman’ on 01.05.2026.
The defendant no.1 has failed to file the written
statement within a period of 30 days. The defendant no.1 has failed to
disclose any justified ground for extension of the time for filing of the
written statement. Therefore, in the present facts and circumstances,
defence of defendant no.1 (Mrs. Laxmi) is struck off. Defendant
(Mrs. Laxmi) is proceeded ex-parte due to non appearance.
From the pleadings of the plaintiff, following notional
issues are framed :-
1.
Whether plaintiff is entitled for the recovery of
Suit Amount, as prayed? (OPP).
2. Whether the plaintiff is entitled to any interest?, if
yes, at what rate and for which period? (OPP)
3.
Relief.
No other issue is arise or pressed for.
Case to come up for ex-parte evidence on 26.09.2026.
